By downloading and using this Application, these terms will apply to you.
GENERAL
1.These Terms & Conditions define the rules of using the MOBILE DIFFUSION - Mobile Application (the Application).
2. All copyrights and patents independent of those vested in the developer as creator have been granted to: N1 RND spółka z ograniczoną odpowiedzialnością (LLC), with its registered office in Poland, Poznań (61-756), Garbary St. no 9, national register of entrepreneurs number KRS: 0001027850, tax number NIP: 7831877488, statistical number REGON: 524871172 - under separate permissions and licenses.
3. Downloading and using the application is not age restricted.
4. You can download the Application only from AppStore (for iOS). The Application can be downloaded by all users of mobile devices with at least iOS 16.2 version or later. Please mind that every user of AppStore is also bound by terms and conditions specified therein. If you have any additional questions regarding AppStore regulations, please feel free to contact Apple or AppStore support directly.
5. The Application works only in offline mode. Using the Application does not require a permanent connection to the Internet. Only downloading the Application through the AppStore requires an internet connection.
6. We may wish to update the Application from time to time – the requirements for the iOS system (and for any additional systems we decide to extend the availability of the Application to) may change, and you will need to download the updates if you want to keep the Application running.
7. The use of the Application is possible for an indefinite period of time. You can stop using the Application at any time and without providing us any reason at all. All you have to do is delete the application files from your device.
CHARGES AND FEES
Downloading and using the Application is free of charge. But if you are downloading the Application outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while downloading the Application. In this matter, you are accepting responsibility for any such charges, including roaming data charges if you download the Application while being abroad without turning off data roaming.
CONDITIONS AND RESTRICTIONS OF USE
1. By downloading and using the Application, you confirm that you will use it in accordance with its intended purpose, in a manner consistent with the law and good practices, taking into account the respect for personal rights, copyrights and intellectual property of the Service Provider, other Users and third parties.
2. By downloading and using the Application you also agree that you will not use the Application:
a) in any way that violates any applicable national, federal, state, local or international law or regulation;
b) to exploit, harm or attempt to exploit or harm minors in any way;
c) to generate or disseminate verifiably false information and/or content for the purpose of harming others;
d) to generate or disseminate personally identifiable information that can be used to harm a person;
e) to defame, disparage or otherwise harass others;
f) for fully automated decision-making that adversely affects an individual's rights or otherwise creates or modifies binding, enforceable obligations;
g) for any use that has the purpose or effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;
h) to the exploitation of the vulnerability of a specific group of people based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person belonging to that group in a way that causes or is likely to cause physical or mental harm to that person or another person;
i) for any use with the purpose or effect of discriminating against individuals or groups based on legally protected characteristics or categories;
i) for generating or disseminating realistic portraits of people or animals being killed, maimed, tortured or abused, or content that encourages violence;
k) for generating or disseminating material deemed sexual or pornographic, defined as "explicit descriptions or displays of sexual organs or activities intended to stimulate erotic feelings rather than aesthetic or emotional feelings."
l) for providing medical advice and interpreting medical results;
m) for generating or disseminating information for use in the administration of justice, law enforcement, immigration or asylum processes, such as predicting that a person will commit fraud/crime (e.g., through text profiling, drawing causal links between claims in documents, non-discriminatory and arbitrary targeted use).
For any damage resulting from violation of the above restrictions on use and for violation of the provisions of these rules and regulations shall be borne by the user.
PERSONAL DATA
Using the Application does not require the creation of any user account. We do not require you to share with us any personal or sensitive data. We do not collect or store any of your sensitive data, including personal identification data and your credit card or other of your payment providers' data. All possibly necessary - for downloading the Application (via AppStore) personal data, sensitive data and possibly payment data are used and stored exclusively by AppStore. COMPLAINTS
1. Any complaints related to the functioning of the Application and the provision of services through the Application can be submitted by e-mail contact@n1rnd.com by our feedback form or by post: Poznań (61-756), Garbary St. no 9.
2. We recommend that the complaint includes: information and circumstances concerning the subject of the complaint, in particular the type and date of the irregularity; claim; contact details of the person lodging the complaint - this will facilitate and speed up handling the complaint. The requirements in the preceding sentence are in the form of a recommendation only and do not affect the effectiveness of complaints made without the recommended description of the complaint.
3. We shall respond to the complaint immediately, not later than within 14 calendar days from the date of its lodging.
THIRD PARTY SERVICES
The Application may contain in the future advertisements and promotions offered by third parties and links to other web sites or resources. We are not responsible for the availability (or lack of availability) of such external websites or resources. We are not responsible or liable for such third parties’ terms or actions.
ADDITIONAL PROVISIONS
1. We can terminate the agreement for the use of the Application with immediate effect and without indicating the reasons by sending to you a relevant statement, and delete the Account.
2. We reserve our right to amend these Terms & Conditions including but not limited to situations like changes in legal regulations; changes in the scope or form of services provided under the Application - to the extent that such changes affect the implementation of the provisions of these
